TERMS OF USE, LICENSE, RISK NOTICE, PAYMENTS AND REFUND POLICY - POLYRUST CLOUD
Last updated: May 19, 2026 Version: 1.1 Party responsible for the service: PolyRust Cloud Official and exclusive support channel: contato@polyrust.com
These Terms of Use, License, Risk Notice, Payments and Refund Policy govern access to, contracting for, activation, use and continued use of PolyRust Cloud, including its dashboards, automations, servers, infrastructure, integrations, documentation, settings, presets, support, updates, APIs, resources, modules and related features.
By making a payment, creating an account, requesting activation, accessing the dashboard, using the software, connecting a wallet, using documentation, receiving support or consuming any PolyRust Cloud resource, the user declares that they have read, understood and fully accepted these Terms.
If the user does not agree with any clause, they must not contract for, pay for, access, activate, install or use PolyRust Cloud.
1. Definitions
For the purposes of these Terms:
- PolyRust Cloud, PolyRust, platform, software, system or service means the technological tool made available by PolyRust Cloud, including the dashboard, operational engine, automations, servers, integrations, documentation, presets, settings, technical resources, updates and related support.
- Party responsible for the service means PolyRust Cloud.
- User, customer, contracting party or licensee means the individual or legal entity that purchases, accesses, tests, activates, uses or interacts with PolyRust Cloud.
- License means the limited, temporary, revocable, non-exclusive, non-transferable right, conditional on compliance with these Terms, to access and use PolyRust Cloud during the contracted period.
- Digital service means remote, online, local, hybrid or server-based access to software, infrastructure, a dashboard, documentation, support, credentials, settings and technical features.
- Activation means any act of enabling, provisioning or making the service available, including account creation, enabling dashboard access, issuing a license, sending instructions, configuring a server, making documentation available, initial support, creating credentials, installation, onboarding or any functional access to the product.
- Actual use means logging in, accessing the dashboard, running the software, configuring parameters, connecting a wallet, reading documentation, consuming support, using a server, generating logs, attempting a trade, checking a balance, checking a market, using a preset, testing, simulation, activating an engine or any operational interaction with PolyRust Cloud.
- Prediction markets, Polymarket, cryptoassets, blockchain, wallet, MetaMask, RPC, CLOB, builder code, builder fee, API, proxy wallet and similar terms refer to technologies, platforms, integrations or third-party services that may be used in conjunction with PolyRust Cloud.
- Financial result means any profit, financial loss, loss, gain, return, yield, performance, balance variation, charge, fee, cost, missed opportunity or economic consequence arising from the use of the software, external markets, cryptoassets, third-party platforms or the user's decisions.
- Crypto payment means any payment made through a blockchain, stablecoin, token, digital wallet, decentralized network or other digital asset accepted by PolyRust Cloud.
2. Nature of the service
PolyRust Cloud is a technological tool for automation, analysis, execution, monitoring and operational support for use in compatible environments, which may include prediction markets, cryptoassets, APIs, digital wallets, servers, market data and external platforms.
PolyRust Cloud is not a bank, brokerage, exchange, financial institution, investment advisory firm, asset manager, research firm, legal consultancy, tax consultancy, custody service, official representative of Polymarket, official representative of any external platform, financial product, investment fund, promise of income or service providing guaranteed returns.
The amount paid by the user compensates for access to the software, a license to use it, infrastructure, servers, development, maintenance, provisioning, documentation, support, integrations and other technical and operational costs of the digital service.
The user acknowledges that they are acquiring access to a technological tool, and not purchasing profit, returns, a guaranteed financial signal, professional asset management, individualized financial advice, an investment or a promise of results.
3. No promise of profit, returns or results
PolyRust Cloud does not promise, guarantee, assure or represent that the use of PolyRust Cloud will produce profit, income, returns, recovery of losses, positive performance, market predictability, a permanent statistical advantage, absence of loss or any specific financial result.
Any demonstration, simulation, screenshot, video, backtest, history, study, setting, preset, comparison, testimonial, operational example or marketing material is merely informational, technical, educational or demonstrative in nature and does not constitute a guarantee of future results.
The user understands and accepts that:
- prediction markets and cryptoassets are volatile and risky;
- past results do not guarantee future results;
- automation can accelerate gains and losses;
- odds, prices, liquidity, APIs and external platforms can change rapidly;
- slippage, delay, partial execution, API error, unavailability, lack of a counterparty, network failure, market resolution error, server failure, a bug, a rule change or human error can cause losses;
- every decision to activate, pause, configure, trade, maintain or discontinue use of the software is the user's sole responsibility.
No PolyRust Cloud content should be interpreted as a personalized investment recommendation, financial advice, a promise of performance, a trade recommendation, a guarantee of profit or a guarantee of absence of loss.
4. Eligibility and user responsibility
By using PolyRust Cloud, the user declares that they:
- are of legal age and have the legal capacity to enter into a contract;
- understand the risks of software, automation, cryptoassets, blockchain, digital wallets and prediction markets;
- are responsible for verifying whether the use of PolyRust Cloud, prediction markets, Polymarket, cryptoassets and external platforms is permitted in their jurisdiction;
- will not use the service to violate laws, sanctions, geographic blocks, external platform rules, third-party terms or regulatory obligations;
- have the minimum knowledge necessary to operate their own wallet, account, password, device, browser, network, VPS, server or technical environment;
- will use PolyRust Cloud on their own behalf, at their own risk and under their own responsibility;
- are not seeking guaranteed profit, a promise of income or certain recovery of losses.
PolyRust Cloud may refuse, suspend or terminate access for users who pose an operational, legal, reputational, technical, financial, regulatory, fraud, abuse or Terms violation risk.
5. License to use
Contracting for PolyRust Cloud grants the user a limited, temporary, revocable, non-exclusive, non-sublicensable and non-transferable license to use the software during the contracted period and in accordance with these Terms.
The license does not transfer intellectual property, source code, technology, algorithms, strategy, trademarks, visual identity, know-how, databases, infrastructure, private documentation, models, business logic or any ownership rights over PolyRust Cloud.
The user is prohibited from:
- reselling, renting, sublicensing, lending, sharing or transferring access;
- copying, cloning, modifying, adapting, decompiling, extracting, reverse engineering or attempting to obtain the source code;
- creating a competing product based on PolyRust Cloud;
- circumventing licensing, authentication, limits, security mechanisms, blocks or control systems;
- sharing credentials with third parties;
- using one license for multiple individuals, companies, wallets, customers or environments without express authorization;
- using the service for fraud, manipulation, money laundering, sanctions evasion, violation of an external platform or unlawful activity;
- removing trademarks, notices, identifiers, builder code, attribution mechanisms or technical controls where applicable.
Violation of this clause may result in immediate suspension, termination of the license, loss of access, preservation of records and the taking of appropriate measures, without an obligation to refund where permitted by applicable law.
6. Account, credentials, wallet and security
The user is solely responsible for the security of their account, email, password, device, browser, operating system, VPS, digital wallet, seed phrase, private key, MetaMask, proxy wallet, API keys, RPC, network and any other resource used in conjunction with PolyRust Cloud.
PolyRust Cloud does not request a seed phrase or a full private key. If the user provides such information to third parties, fake websites, malicious extensions, unofficial channels, unverified applications or scammers, they will fully assume the resulting risks.
PolyRust Cloud is not responsible for losses arising from:
- a leaked password;
- an infected device;
- malware;
- phishing;
- a fake extension;
- use of a VPN, proxy or unsuitable network;
- an insecure connection;
- sharing access;
- a configuration error;
- loss of a seed phrase;
- improper signing of a transaction;
- a compromised wallet;
- access by unauthorized third parties;
- the user's negligence, recklessness or lack of skill.
The user must immediately report any suspected unauthorized access through the official and exclusive support channel: contato@polyrust.com. PolyRust Cloud may temporarily suspend access for operational protection, without this creating an automatic right to a refund.
7. Third-party integrations
PolyRust Cloud may depend on platforms, networks, APIs, servers, wallets, blockchain, cloud providers, RPC providers, browsers, extensions, Polymarket, exchanges, data services, authentication services, payment providers and other third parties.
The user acknowledges that PolyRust Cloud does not control such external services and is not responsible for:
- third-party instability;
- API changes;
- account blocks;
- platform unavailability;
- rule changes;
- geographic restrictions;
- blockchain failures;
- network delays;
- congestion;
- fee increases;
- RPC failures;
- third-party maintenance;
- changes to the policies of Polymarket or any other platform;
- future incompatibility resulting from external updates;
- external data or feed errors;
- failure, suspension, freezing or closure of an account with an external service.
PolyRust Cloud may update, modify, suspend or remove integrations at any time to preserve security, compliance, stability, compatibility or operational viability.
8. Polymarket, prediction markets and external platforms
If the user uses PolyRust Cloud in conjunction with Polymarket or any prediction market, they declare that they:
- have read and agree to the external platform's terms;
- are responsible for verifying whether their region permits use of the platform;
- will not use PolyRust Cloud to circumvent blocks, restrictions, sanctions, geofencing, KYC, platform controls or applicable rules;
- understand that PolyRust Cloud is not Polymarket, does not represent Polymarket and does not control the platform's decisions;
- fully assume the risks of suspension, blocking, limitation, loss of access, rule changes, market closure, resolution error or any external event.
PolyRust Cloud will not be responsible for losses arising from misuse, violation of third-party rules or unavailability of external platforms.
9. Builder code, charges, fees and attribution
Where applicable, the user acknowledges that trades made through PolyRust Cloud may include identification, attribution, builder code, builder fee, an operational charge, a technical commission, spread, an execution cost, a network fee, a platform fee, an infrastructure cost or another compensation mechanism permitted by the service's architecture or the external platform.
By using PolyRust Cloud, the user authorizes trades made through the software to contain, where applicable, the technical or commercial attribution associated with PolyRust Cloud.
These amounts do not represent a promise of management, financial advice, custody of funds or guaranteed participation in the user's results. They are forms of compensation for the software, technology, infrastructure, development, maintenance and support.
PolyRust Cloud may change the structure of charges, builder fees, plans, prices, commercial terms and billing models by updating the sales page, checkout, dashboard, notifying the user or entering into a new contract.
10. Settings, presets, parameters and strategies
PolyRust Cloud may offer settings, presets, technical suggestions, default parameters, risk models, entry windows, limits, filters, thresholds, stops, automations, usage examples and educational materials.
Every preset or setting must be understood as a technical starting point and not as personalized financial advice.
The user is responsible for reviewing, adjusting, testing, validating and deciding whether to activate any setting.
PolyRust Cloud is not responsible for losses arising from:
- use of an unsuitable setting;
- aggressive parameters;
- absence of a stop;
- inadequate bankroll management;
- a volatile market;
- lack of liquidity;
- activation without testing;
- an incorrect manual change;
- use that is incompatible with the user's risk profile;
- copying third-party settings without independent validation;
- relying on a preset as a promise of profit.
11. Artificial intelligence, backtests and optimizations
If PolyRust Cloud uses or comes to use artificial intelligence, statistical optimization, backtests, machine learning, data analysis, Bayesian models, simulations, automated recommendations, market analysis or any similar feature, the user acknowledges that such features may contain errors, limitations, bias, delay, inaccuracy, overfitting, inconsistency, flawed assumptions or unsuitability for the real market.
No AI, backtest, optimization or automated analysis feature should be understood as a guarantee of profit, an infallible signal, financial advice or a personalized recommendation.
The user must validate every result before activating real trades.
PolyRust Cloud may limit, suspend, modify or remove AI features without an obligation to provide compensation, when necessary for security, cost, compliance, stability, accuracy or product development.
12. Risks of automated execution
The user understands that automated systems can trade faster than manual trading and, therefore, can generate rapid losses.
The risks include:
- execution at an unfavorable time;
- slippage;
- latency;
- API error;
- duplicate execution;
- partial execution;
- lack of liquidity;
- a market resolved in an unexpected way;
- internet failure;
- server outage;
- cloud provider failure;
- an external platform bug;
- changes in odds;
- delay in the data feed;
- clock or synchronization error;
- signing failure;
- wallet instability;
- blocking or limitation by third parties;
- sudden changes to the market rules;
- total or partial loss of the capital exposed.
The user fully assumes these risks and acknowledges that automation should be used with caution, risk limits and amounts consistent with their tolerance for loss.
13. Payments
Payments may be made through cryptoassets, stablecoins, blockchain, Pix, card, boleto, transfer, gateways, external checkout or any other means accepted by PolyRust Cloud at the time of contracting.
The granting of access may depend on payment confirmation, anti-fraud checks, network validation, blockchain confirmation, manual approval, buyer identification, gateway settlement or risk analysis.
PolyRust Cloud may refuse payments that present suspected fraud, unlawful origin, inconsistency, network error, an incorrect amount, attempted abuse, sanctions violation, association with risky wallets or reputational risk.
Amounts paid compensate for the digital service, license, access, infrastructure, support and provisioning, and not an investment deposit, operational balance, performance guarantee or capital managed by PolyRust Cloud.
14. Cryptoasset payments
By paying in cryptoassets, the user declares that they understand that:
- blockchain transactions are, as a rule, irreversible by the network itself;
- there is no automatic chargeback as with credit cards;
- network fees, gas fees, bridge fees, exchange fees and similar costs are not controlled by PolyRust Cloud;
- sending to the wrong address, wrong network, wrong token or an incorrect amount is the sender's responsibility;
- exchange rate fluctuations between the dollar, real, stablecoin, token or cryptoasset do not create an automatic right to an adjustment;
- any refund, when approved or legally required, may be subject to deductions for network costs, fees, exchange rate differences, processing expenses and operational charges, where permitted by applicable law;
- PolyRust Cloud may require confirmation of wallet ownership before any refund review;
- PolyRust Cloud may refuse suspicious transactions associated with fraud, money laundering, sanctions, mixers, risky wallets or an incompatible origin.
A crypto payment does not mean contractual anonymity. PolyRust Cloud may record the wallet, transaction hash, date, amount, network, plan, email provided, access IP, activation logs and other information necessary for security, accounting, fraud prevention, support and the defense of rights.
15. Plans, terms and access
Access to PolyRust Cloud will be made available according to the contracted plan, such as monthly, quarterly, annual, limited lifetime, experimental, promotional, beta, trial, invitation, individual license or another format communicated at the time of purchase.
Unless expressly provided otherwise, monthly plans correspond to periods of 30 calendar days, quarterly plans correspond to approximately 90 calendar days and annual plans correspond to approximately 365 calendar days, counted from activation or payment confirmation, as defined by PolyRust Cloud.
The user's lack of use does not automatically suspend, freeze, renew or extend the contracted term.
PolyRust Cloud may terminate or suspend access at the end of the contracted period, for non-payment, violation of these Terms, operational risk, fraud, abuse, intellectual property infringement or a legal order.
16. Refund policy
This Refund Policy forms part of these Terms.
The user acknowledges that PolyRust Cloud is a digital service involving the granting of access, technical provisioning, infrastructure consumption, server costs, support, maintenance, updates, integrations and the immediate availability of resources after payment confirmation.
As a commercial policy, refunds will not be granted where there has been:
- activation of access;
- actual use of the dashboard, software, documentation, server, support or any resource;
- license provisioning;
- environment configuration;
- infrastructure consumption;
- use for any period, however short;
- withdrawal after accessing the product;
- an unmet expectation of profit;
- an operational loss incurred by the user;
- subjective incompatibility with the product;
- a lack of technical knowledge on the user's part;
- a decision to discontinue due to a change of mind;
- a failure arising from external platforms;
- third-party blocking, restriction or unavailability;
- an attempt to use the service in an incompatible country, region, platform or environment;
- a violation of these Terms by the user.
Refunds may be considered, at PolyRust Cloud's sole discretion or when required by applicable law, in the following circumstances:
- a proven duplicate charge;
- payment made in an incorrect amount and identified before activation;
- a proven serious technical failure, attributable exclusively to PolyRust Cloud, that entirely prevents access to the service and is not resolved within a reasonable time;
- failure to deliver access after valid payment confirmation;
- an applicable legal, administrative or judicial obligation.
Refund requests must be sent exclusively through the official and exclusive support channel, contato@polyrust.com, containing:
- full name;
- email used for the purchase;
- plan purchased;
- purchase date;
- payment method;
- transaction hash, for crypto payments;
- screenshots and logs of the problem;
- an objective description of the reason;
- source wallet and any destination wallet, where applicable.
A lack of sufficient information may prevent or delay the review.
PolyRust Cloud may deny requests that are abusive, contradictory, unfounded, incomplete, fraudulent, threatening or unsupported by technical evidence.
Nothing in these Terms limits mandatory and non-waivable consumer rights where applicable law so requires. Where a mandatory rule applies, PolyRust Cloud will review the case in accordance with the law, the contracting records, the user's acceptance, service delivery, activation, actual use, costs incurred, the digital nature of the product and the presence or absence of a proven technical failure.
17. Right of withdrawal and local law
The user understands that rules on withdrawal, cancellation, returns and refunds vary according to the country, state, type of contract, nature of the product, method of delivery, buyer profile, time of activation and applicable law.
Where local law grants a mandatory right of withdrawal, cancellation or refund, that right will be respected to the extent required by applicable law.
Where the law permits exceptions, limitations or defenses for digital products, services already provided, immediate access, consumed content, an activated license, provisioned infrastructure or actual use, PolyRust Cloud may apply them to protect its operation.
PolyRust Cloud recommends that the user read these Terms before payment and complete the purchase only if they agree with the commercial policy, risks, nature of the service and absence of a promise of profit.
18. Cancellation
Cancellation of future renewal, where there is a recurring subscription, prevents new charges but does not automatically result in a refund for periods already paid for, activated or used.
Cancellation does not remove the user's responsibility for overdue payments, outstanding fees, prior violations, misuse, losses caused, legal obligations or clauses that by their nature must remain in force.
Where the plan is not recurring, a mere cancellation request does not result in an automatic refund of amounts paid.
19. Support
The official and exclusive support channel for PolyRust Cloud is contato@polyrust.com.
Support is intended to assist with reasonable use of the product and does not include:
- financial advice;
- a guarantee of profit;
- manual trading for the user;
- portfolio management;
- recovery of losses;
- support for third-party platforms outside PolyRust Cloud's control;
- support for an infected computer, a misconfigured VPS or an incompatible environment;
- unlimited training;
- 24-hour service, unless expressly contracted;
- custom development without a specific contract.
PolyRust Cloud may request screenshots, logs, videos, error messages, technical information and evidence for analysis.
The user's refusal to provide technical information may limit or prevent support.
Abusive conduct, threats, insults, blackmail, harassment, improper exposure, attempted coercion, false accusations or incompatible behavior may result in termination of support, suspension of the license and preservation of records for PolyRust Cloud's defense.
20. Availability, maintenance and updates
PolyRust Cloud will seek to keep the service available, stable and functional, but does not guarantee uninterrupted availability, absence of bugs, permanent compatibility with third parties or perfect execution in all environments.
The service may become unavailable due to:
- scheduled maintenance;
- emergency maintenance;
- server instability;
- third-party failure;
- a cyberattack;
- an external platform update;
- an API change;
- a bug fix;
- overload;
- a force majeure event;
- a technical, legal, commercial or regulatory decision.
PolyRust Cloud may change features, the interface, parameters, technical requirements, servers, technologies, plans, documentation, authentication systems and integrations at any time.
Updates may change how the product is used and may require new configuration by the user.
21. Limitation of liability
To the maximum extent permitted by applicable law, PolyRust Cloud will not be liable for:
- lost profits;
- loss of opportunity;
- loss of capital;
- loss of cryptoassets;
- loss of access to a wallet;
- loss of an account on external platforms;
- third-party blocks, bans or restrictions;
- financial losses arising from trades;
- the user's decisions;
- configuration errors;
- internet instability;
- API unavailability;
- blockchain failures;
- slippage;
- insufficient liquidity;
- market resolution errors;
- third-party server failure;
- misuse;
- violation of law by the user;
- indirect, incidental, special, punitive, moral, reputational or consequential damages, where such limitation is permitted.
Where the law does not permit total exclusion of liability, PolyRust Cloud's maximum liability, if recognized by a final decision, will be limited to the amount actually paid by the user for the specific plan related to the event complained of, excluding trading amounts, market losses, invested capital, third-party fees, gas fees, spread, foreign exchange costs and indirect damages, unless applicable law provides for a different limit.
22. Disclaimer of warranties
PolyRust Cloud is provided "as is" and "as available", without any guarantee of uninterrupted operation, absolute absence of error, fitness for a specific purpose, permanent compatibility with third parties, returns, performance, profit or financial results.
PolyRust Cloud does not guarantee that:
- the software will always work without failures;
- all bugs will be fixed immediately;
- external platforms will remain compatible;
- markets will have sufficient liquidity;
- orders will be executed at exactly the expected price;
- the user will make a profit;
- the user will avoid losses;
- settings will be suitable for all profiles;
- the product will be compatible with all versions of Windows, VPS, browser, wallet, RPC, exchange, network or infrastructure.
23. Responsibility for financial decisions
The user acknowledges that every trade made in prediction markets, cryptoassets or compatible platforms results from their own decision to activate, configure and use the software.
PolyRust Cloud does not manage the user's funds, does not unilaterally decide entry amounts, does not guarantee results and does not assume responsibility for losses.
The user must trade only amounts they are willing to lose entirely.
The user is responsible for consulting qualified professionals if they need financial, legal, tax, accounting or regulatory guidance.
24. Acknowledgment of risk
By accepting these Terms, the user expressly declares that they understand and accept that:
- they may lose money using PolyRust Cloud;
- they may lose all capital allocated to trading;
- automations may increase risks;
- results are not guaranteed;
- cryptoassets and prediction markets are risky;
- external platforms may block, limit or change rules;
- crypto payments are irreversible at the network level;
- technical support is not financial advice;
- presets are not investment recommendations;
- the amount paid is for access to the software and infrastructure, not for profit.
25. Acceptable use
The user agrees not to use PolyRust Cloud for:
- illegal activities;
- fraud;
- money laundering;
- unlawful financing;
- sanctions violations;
- market manipulation;
- abusive creation of multiple accounts;
- evasion of geographic blocks;
- attacks on systems;
- unauthorized scraping;
- reverse engineering;
- unauthorized resale;
- license sharing;
- intellectual property infringement;
- harassment, threats or abuse against staff, partners or other users;
- any conduct that creates legal, technical, commercial or reputational risk for PolyRust Cloud.
PolyRust Cloud may suspend or terminate access in the event of reasonable suspicion of a violation, without an obligation to provide prior notice when necessary to protect the service.
26. Intellectual property
All of PolyRust Cloud, including its trademark, name, logo, design, code, architecture, documentation, workflows, strategies, presets, texts, screens, dashboards, databases, automations, APIs, materials, videos, tutorials, visual identity, business logic, models and know-how, belongs to PolyRust Cloud or its licensors.
No intellectual property rights are transferred to the user.
Copying, reproducing, distributing, publishing, reselling, modifying, adapting, commercially exploiting or creating derivatives of PolyRust Cloud without express written authorization is prohibited.
Violations may result in suspension of access, removal of the license and the taking of appropriate legal measures.
27. Confidentiality
The user agrees not to publicly disclose confidential, technical, strategic or internal PolyRust Cloud information, including credentials, endpoints, private parameters, internal screens, restricted documentation, operational methods, non-public strategies, other users' data, commercial information, private support conversations, codes, tokens, keys or internal mechanisms.
This obligation does not prevent the user from exercising mandatory legal rights, but does not authorize disclosure that is abusive, false, fraudulent, manipulated or in violation of trade secrets.
28. Feedback, suggestions and improvements
If the user submits ideas, suggestions, improvements, reports, feedback, screenshots, videos, logs, feature proposals or comments about PolyRust Cloud, they authorize PolyRust Cloud to use such contributions to improve the product, without any obligation to provide payment, credit, royalties or compensation, unless otherwise agreed in writing.
29. Data, logs and operational monitoring
For security, support, fraud prevention, legal compliance, internal auditing and product improvement, PolyRust Cloud may collect and store data such as name, email, phone number if provided by the user, license identifiers, wallet address provided, transaction hash, IP, login date and time, activation events, technical logs, errors, settings used, connection status, device information, support interactions, contracted plan, payment history and records of acceptance of the Terms.
Data collection and processing will be carried out in accordance with the Privacy Policy and applicable law.
30. Privacy and data protection
The user must read the Privacy Policy before using PolyRust Cloud.
PolyRust Cloud may process personal data for performance of the contract, support, security, fraud prevention, compliance with a legal obligation, the regular exercise of rights, communication with the user, product improvement and legitimate interests, as permitted by applicable law.
The user is responsible for not entering third-party data into PolyRust Cloud without legal authorization.
PolyRust Cloud will adopt reasonable security measures, but no system is absolutely immune to failures, attacks or leaks.
31. Taxes, declarations and fiscal obligations
The user is solely responsible for calculating, declaring and paying levies, taxes, fees and fulfilling fiscal, accounting or regulatory obligations arising from their trades, gains, losses, payments, receipts, cryptoassets, currency conversions and activities in prediction markets.
PolyRust Cloud does not provide tax advice and is not responsible for the user's tax omissions.
32. Official communications
The official and exclusive support channel is contato@polyrust.com.
PolyRust Cloud may communicate with the user through their registered email, the dashboard, website, internal notifications, checkout or official documentation.
The user is responsible for keeping their contact details up to date.
Messages sent to the registered email or made available in the dashboard will be deemed received, unless proven otherwise.
33. Suspension and termination of access
PolyRust Cloud may suspend or terminate the user's access, with or without prior notice, in the event of a violation of these Terms, non-payment, fraud, suspected unlawful use, intellectual property infringement, sharing of access, threats, harassment or abuse against support, an improper chargeback attempt, attempted extortion, a risk to system security, a legal order, a third-party requirement, discontinuation of the product, or technical, commercial or regulatory unviability.
Suspension or termination due to the user's fault does not create an automatic right to a refund, except where there is an applicable legal obligation.
34. Abusive conduct, threats and attempts at coercion
PolyRust Cloud values respectful service, technical solutions and professional communication.
Threats, insults, blackmail, extortion, malicious exposure, defamation, false accusations, attempts to obtain a refund through intimidation, manipulation of screenshots, document fraud, coordinated attacks, abuse of support, discriminatory language or harassment against staff or partners will not be tolerated.
PolyRust Cloud may preserve logs, messages, audio recordings, screenshots, payment records, usage records and other evidence for the defense of rights.
Nothing in this clause prevents the user from exercising legal rights, submitting a legitimate complaint, approaching competent authorities or expressing a truthful opinion in good faith.
35. Proof of delivery, activation and use
For support, auditing, defense of rights, refund review and fraud prevention, PolyRust Cloud may keep records of payment confirmation, transaction hash, paying wallet, email provided, acceptance of the Terms, activation date and time, license creation, dashboard access, server use, execution logs, support consumption, screenshots and exchanged messages, configuration changes, technical events and delivery status.
Such records may be used to prove delivery of the service, actual use, absence of a promise of profit, absence of a technical failure and contractual compliance.
36. Beta, testing and experimental features
PolyRust Cloud may offer features that are beta, experimental, early access, unstable, under testing or subject to change.
Beta features may present bugs, instability, limitations, future removal, changes in behavior or incompatibility.
The use of beta features is at the user's own risk.
37. Changes to the product and the Terms
PolyRust Cloud may update these Terms at any time to reflect legal, technical, commercial, regulatory, operational or product changes.
The updated version may be published on the website, dashboard, checkout, documentation or sent through an official channel.
Continued use of PolyRust Cloud after an update represents acceptance of the new Terms.
If the user does not agree with future changes, they must discontinue use of the service.
38. Termination, discontinuation or migration of the service
PolyRust Cloud may terminate, migrate, sell, transfer, merge, pause, discontinue or replace PolyRust Cloud, in whole or in part, for commercial, technical, regulatory, financial, strategic or security reasons.
Where possible, PolyRust Cloud will seek to notify active users with reasonable advance notice.
In the event of discontinuation, PolyRust Cloud may offer a technical alternative, migration, proportional credit or another commercial solution, according to the situation and applicable law.
39. Force majeure
PolyRust Cloud will not be responsible for delay, failure, unavailability or loss arising from events beyond its reasonable control, including natural disasters, war, civil conflict, pandemic, strikes, power failure, internet failure, cyberattacks, governmental acts, regulatory blocks, blockchain failures, provider instability, third-party server outages, abrupt API changes or extreme market events.
40. Indemnification
The user agrees to indemnify and hold harmless PolyRust Cloud, those responsible for it, its staff, contractors, affiliates, partners, suppliers and representatives against claims, losses, damages, liabilities, costs, fines, expenses and professional fees arising from misuse of PolyRust Cloud, violation of these Terms, violation of law, infringement of third-party rights, fraud, manipulation, unauthorized sharing, use in a prohibited jurisdiction, the user's financial transactions, violation of external platform terms, false information provided by the user or abusive or unlawful behavior.
41. Relationship between the parties
These Terms do not create a partnership, joint venture, franchise, representation, employment relationship, mandate, asset management, financial advisory relationship, fiduciary relationship or wealth administration between PolyRust Cloud and the user.
The user acts independently and takes full responsibility for their decisions.
42. Assignment and transfer
The user may not assign, transfer or sublicense their account, license, rights or obligations without PolyRust Cloud's express authorization.
PolyRust Cloud may assign or transfer these Terms, the product, the contractual base or related assets in the event of reorganization, sale, merger, acquisition, partnership, migration or operational change.
43. Partial invalidity
If any clause of these Terms is deemed invalid, illegal or unenforceable, the remaining clauses will remain valid and effective to the maximum extent permitted by law.
The invalid clause must be interpreted or replaced by a valid provision that most closely reflects the original intent.
44. Non-waiver
PolyRust Cloud's tolerance of any breach will not be considered a waiver of rights, forgiveness, contractual amendment or authorization for further violations.
PolyRust Cloud may exercise its rights at any time.
45. Applicable law and dispute resolution
These Terms will be interpreted in accordance with the law applicable to the specific case, considering the nature of the service, the place of contracting, the user's profile, the payment method, the user's jurisdiction and any mandatory rules that may apply.
Where legally permitted, any disputes must initially be addressed through the official and exclusive support channel, contato@polyrust.com, with an objective presentation of data, screenshots, logs and a description of the problem.
Nothing in these Terms prevents the user from exercising mandatory legal rights before competent authorities.

After activation or actual use of the service, we do not grant refunds for withdrawal, an expectation of profit, operational loss, subjective incompatibility, a decision to discontinue, lack of technical knowledge, third-party failures or a change of mind. Response template for a refund request
Hello.
I understand your request.
As stated in the Terms accepted at the time of contracting, PolyRust Cloud is software/a digital service with immediate access, and not a promise of profit, a guaranteed investment or financial advice.
We have verified that access was activated and the service was made available/used, with consumption of infrastructure, a license, a server, documentation, support and operational resources. We have also not identified, to date, any serious technical failure attributable exclusively to PolyRust Cloud that entirely prevented delivery of the service.
For this reason, in accordance with our Refund Policy, we will not approve the requested refund in this case.
We reiterate that crypto payments do not have automatic chargeback on the blockchain network. Any refund, where applicable, depends on a commercial review or a specific legal obligation.
You remain free to use the legal channels you consider appropriate, and we will present the records of contracting, acceptance of the Terms, activation, delivery, use of the service, absence of a promise of profit and the commercial policy accepted at the time of purchase.
Sincerely, PolyRust Cloud Team
